3. Account Requirements

• You must be at least 18 years of age to use the Service
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You must have the authority to connect any Facebook Pages or Instagram accounts you add to the Service
• You are responsible for all activity that occurs under your account

4. Meta Platform Compliance

The Service integrates with Meta Platforms (Facebook and Instagram) APIs. By using the Service, you also agree to comply with:

You are solely responsible for ensuring that your use of the Service complies with Meta's policies, including but not limited to their community standards and advertising policies.

5. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited messages, or automated bulk communications
• Harass, abuse, or threaten other users or social media users
• Post misleading, deceptive, or fraudulent content
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with or disrupt the Service or its infrastructure
• Use the Service in a way that violates Meta's community standards
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use automated tools to scrape or extract data from the Service beyond its intended functionality

6. AI-Generated Content

The Service uses artificial intelligence to generate reply suggestions and perform sentiment analysis. You acknowledge that:

• AI-generated replies are suggestions only and should be reviewed before posting
• You are solely responsible for any content you approve and post through the Service
• AI suggestions may not always be accurate, appropriate, or aligned with your brand voice
• We do not guarantee the accuracy or suitability of AI-generated content

7. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by Circlify AI. You retain ownership of all content you create and post through the Service. By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions. Additionally, the Service depends on third-party APIs (Meta, OpenRouter) which may have their own availability constraints.

9. Limitation of Liability

To the maximum extent permitted by law, Circlify AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Circlify AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in activities that harm the Service or other users. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will cease immediately. You may request deletion of your data as described in our Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
